Please read these Terms of Service ("Terms") carefully before using the StreamEar mobile application ("App"). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using StreamEar, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Description of Service

StreamEar is a real-time global news and emergency alert system that:

Aggregates publicly available information from news sources, social media, and emergency systems
Delivers audio and push notifications for breaking news and critical events
Provides pattern detection and trend analysis of global events
Offers customizable region-based filtering and alert preferences

⚠️ Important Notice: StreamEar is an informational tool for situational awareness. It is NOT intended as a primary source for emergency response, life-safety decisions, or official government alerts. Always verify critical information through official sources.

3. Free Access During Beta

StreamEar is currently offered free of charge during our beta period. We reserve the right to introduce paid features or subscriptions in the future with advance notice to users.

4. User Responsibilities

4.1 Eligibility

You must be at least 13 years old to use StreamEar. By using the App, you represent that you meet this age requirement.

4.2 Acceptable Use

You agree to use StreamEar only for lawful purposes. You will NOT:

Use the App to spread misinformation or incite violence
Attempt to reverse engineer, decompile, or hack the App
Scrape, copy, or redistribute App content for commercial purposes
Interfere with the App's servers or networks
Use automated systems (bots, scrapers) to access the App
Violate any applicable laws or regulations

4.3 Account Security

You are responsible for maintaining the security of your device and any data stored locally by the App. Use device passcodes, biometric authentication, and keep your iOS up to date.

5. Content and Accuracy

5.1 Third-Party Content

StreamEar aggregates content from third-party sources (news agencies, social media, public feeds). We do not create, endorse, or verify the accuracy of this content.

5.2 No Warranty of Accuracy

Alerts and information are provided "AS IS." We make no guarantees regarding:

Accuracy, completeness, or timeliness of alerts
Availability or reliability of the service
Freedom from errors, bugs, or interruptions

5.3 AI-Generated Content

StreamEar uses AI (Google Gemini) to classify, translate, and summarize alerts. AI-generated content may contain errors or biases. Always verify important information through multiple sources.

6. Intellectual Property

6.1 Our Rights

StreamEar and its original content, features, and functionality are owned by us and protected by international copyright, trademark, and other intellectual property laws.

6.2 Third-Party Content

News articles, social media posts, and other aggregated content remain the property of their respective owners. StreamEar displays this content under fair use for informational purposes.

6.3 User License

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAMEAR IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability or fitness for a particular purpose
Accuracy, reliability, or availability of the service
Uninterrupted, secure, or error-free operation
Freedom from viruses or harmful components

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Service interruptions, delays, or errors
Decisions made based on App content
Third-party content or actions

OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS (WHICHEVER IS GREATER).

9. Indemnification

You agree to indemnify and hold harmless StreamEar, its affiliates, and personnel from any claims, damages, or expenses arising from:

Your use of the App
Violation of these Terms
Violation of any rights of another party
Your negligence or misconduct

10. Emergency Situations

⚠️ CRITICAL DISCLAIMER:

StreamEar is NOT an official emergency alert system
Do NOT rely solely on StreamEar for life-safety decisions
In emergencies: Call local emergency services (911, 112, etc.)
Always verify critical alerts through official government sources

We are not responsible for delays, missed alerts, or inaccuracies during emergencies.

11. Privacy and Data

Your use of StreamEar is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in the Privacy Policy.

12. Push Notifications

By enabling push notifications, you consent to receive alerts from StreamEar. Notifications may be sent at any time based on your preferences. You can disable notifications at any time in iOS Settings.

13. Changes to the Service

We reserve the right to:

Modify, suspend, or discontinue any part of the App at any time
Change pricing or introduce subscription fees with 30 days' notice
Update features, content sources, or functionality
Limit access to certain features or regions

14. Termination

14.1 By You

You may stop using the App at any time by uninstalling it from your device.

14.2 By Us

We may suspend or terminate your access to the App if you violate these Terms or engage in harmful conduct.

15. Geographic Restrictions

StreamEar is available globally, but some features or content sources may be restricted in certain regions due to:

Local laws and regulations
Content licensing restrictions
Technical limitations

16. Third-Party Links

StreamEar may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of these external sites.

17. Governing Law

These Terms are governed by the laws of Kuwait. Any disputes shall be resolved in the courts of Kuwait, except where prohibited by local law (e.g., EU consumers may bring claims in their home country).

18. Dispute Resolution

18.1 Informal Resolution

Before filing a claim, you agree to contact us at support@streamear.app to attempt to resolve the dispute informally.

18.2 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration, except where prohibited by law.

19. Changes to Terms

We may update these Terms at any time. We will notify you of significant changes by:

In-app notification
Email (if you provided one)
Updating the "Last Updated" date above

Continued use of the App after changes constitutes acceptance of the new Terms.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StreamEar regarding the use of the App.

You must comply with Apple's App Store Terms of Service
